TERMS OF USE

§ 1 Scope of application

These terms of use govern the use of the X-Crate outdoor game box and the associated digital content on the X-Crate online game site, provided by Fuchs Fabio, Rieckmann Ben Dierk GbR (hereinafter referred to as „X-CRATE“ or „Provider“), Beethovenstraße 6, 63768 Hösbach, Germany.

They apply to all users, regardless of whether the box was rented via the pay-per-use model, set up at a location via the provision model or purchased once. By using the box or accessing the online game site, the user recognises these terms of use.

§ 2 Use of the X-Crate Box (pay-per-use)
Access & Booking

Access to the X-Crate Box in the pay-per-use model takes place exclusively via the online booking form. After successful booking and payment, the user receives an e-mail:

  • a booking confirmation with all booking details,
  • the PIN code to open the lock,
  • a link to the digital return process.

The PIN code is personal and may not be passed on to third parties. Passing it on to third parties does not release the person making the booking from their responsibility for the box.

Useful life

Use is limited to the period booked. An extension is only possible by making a new booking. If the box is used beyond the booked period without making a new booking, this shall be deemed as non-fulfilment of the obligation to return the box with the consequences described in the GTC (§ 4, § 5).

Responsibility for the box

Upon receipt of the PIN code, the user assumes responsibility for the box and its contents. The user is obliged:

  • to use the box carefully and as intended,
  • box and contents from damage, loss and theft,
  • not to make any changes to the box, lock or contents,
  • to use the box exclusively for private leisure use (no commercial subletting).
§ 3 Deposit

In the pay-per-use model, a deposit is charged for each booking. The amount and refund conditions are set out in § 4 of the General Terms and Conditions of X-CRATE regulated.

Summary of the main deposit rules:

  • The deposit is collected together with the usage fee via Stripe when the booking is finalised.
  • It will be refunded within 7 days of complete and proper return.
  • If the return is not completed within 48 hours of the end of the booking, the deposit will be retained.
  • Damage or loss may result in full or partial forfeiture of the deposit.
§ 4 Return process

The box can only be returned via the digital return process on the X-CRATE website. The following steps must be carried out:

  1. Call up the return link (from the booking confirmation e-mail or via the website)
  2. Confirm completeness and condition of the box
  3. Upload a photo of the condition of the box
  4. Confirm return and finalise process

The return is only considered complete when all steps have been completed. A mere notification by e-mail is not sufficient.

§ 5 Use of the digital game site
Contents provided

The X-Crate online game site provides the following content:

  • Game instructions in several languages
  • Digital game variants and updates
  • Additional interactive content
Authorised use

The use of digital content is only permitted for users who are in possession of an X-Crate Box (through purchase, loan or access via accommodation). Any other use, in particular commercial utilisation, is not permitted.

Prohibited acts

It is expressly forbidden:

  • copying, downloading, reproducing or passing on content to third parties,
  • create and distribute screenshots or recordings of game content,
  • to use the game site for commercial purposes outside of X-Crate use,
  • to circumvent or manipulate technical protection mechanisms,
  • to pass on access to unauthorised third parties.

Violations of these rules may result in immediate blocking of access and legal action.

§ Section 6 Intellectual property

All contents of the X-Crate online game site (texts, images, videos, instructions, games, graphics) are protected by copyright and are the property of Fuchs Fabio, Rieckmann Ben Dierk GbR. Commercial use, reproduction or editing of the content is prohibited without express written authorisation. Infringements will be prosecuted and may have consequences under civil and criminal law.

§ 7 Technical availability & liability

X-CRATE endeavours to provide the online gaming site permanently and without disruption. However, there is no entitlement to uninterrupted availability. X-CRATE is not liable for:

  • technical failures, maintenance work or interruptions,
  • Data loss due to technical faults,
  • Damage caused by attacks by third parties (e.g. hacking, DDoS),
  • Damage caused by improper use of the box or the digital content.

Liability for intent and gross negligence as well as for damages resulting from injury to life, body and health remains unaffected.

§ 8 Data protection

The processing of personal data is carried out in accordance with the Privacy policy of X-CRATE. Payment is processed via Stripe Payments Europe, Ltd. X-CRATE does not store any complete payment data.

§ 9 Changes to the terms of use

X-CRATE reserves the right to amend these terms of use if this is necessary for legal, technical or organisational reasons. Users will be informed of any significant changes on the website. In the pay-per-use model, the current version at the time of booking applies.

§ 10 Applicable law & final provisions

German law shall apply. Mandatory legal regulations in the user's country of residence remain unaffected.

Should a clause of these Terms of Use be invalid, the remaining provisions shall remain unaffected. The invalid clause shall be replaced by a valid provision that comes closest to the economic purpose.

These terms of use apply in addition to the General Terms and Conditions of X-CRATE. In the event of contradictions, the GTC shall take precedence.
